Terms & Conditions
Welcome to Musical Minds. These Terms & Conditions (“Terms”) govern your enrolment, participation, and payments for lessons, memberships, and services provided by Musical Minds (“we”, “us”, “our”). By enrolling in lessons, creating an account, or making a payment, you agree to be bound by these Terms.
1. Services
Musical Minds provides music education services, including weekly lessons, group classes, and related educational activities. Lesson formats, durations, and schedules are outlined at the time of enrolment.
2. Lesson Packages & Commitment
Some lesson offerings are sold as fixed-term lesson packages (for example, 10 lessons delivered weekly) but are billed monthly to make payments easier.
- You are committing to the full number of lessons in that package (e.g. 10 lessons).
- The package represents a total fee, which may be split into monthly instalments.
- The package is not a month-to-month casual arrangement unless we clearly state otherwise in writing.
Commitment clause: If you enrol in a fixed-term package (e.g. 10 lessons) and are billed monthly, you remain financially liable for the full package cost even if you cancel partway through. Cancelling will stop future automatic debits, but it does not waive the remaining balance owed. Any unpaid balance may be invoiced and must be paid.
3. Payments, Stripe & Direct Debit (BECS)
Payments are processed via Stripe. Where you choose (or are set up on) Direct Debit, you will be asked to agree to a BECS Direct Debit Request (DDR) and the applicable Direct Debit Service Agreement, authorising us to debit your nominated bank account for fees when they fall due.
- Automatic payments are taken on a monthly schedule using the payment method you provide.
- It is your responsibility to ensure your payment details are current and that sufficient funds are available.
- If a payment fails or is declined, we may suspend lessons until the account is brought up to date.
- All fees are stated in Australian Dollars (AUD) unless otherwise specified.
4. Cancellations, Missed Lessons & Make-Ups
- Missed lessons without adequate notice may be forfeited.
- Make-up lessons are not guaranteed and are subject to instructor availability and scheduling constraints.
- Ongoing illness or exceptional circumstances may be considered at our discretion.
Please contact us as early as possible if you are unable to attend a scheduled lesson.
5. Termination by Musical Minds
We reserve the right to suspend or terminate services if payments remain outstanding, there is repeated non-attendance, or behaviour is unsafe, disruptive, or inappropriate. Where a fixed-term package applies, any outstanding balances for the committed package remain payable.
6. Changes to Lessons or Scheduling
We may occasionally need to adjust lesson times, instructors, or formats due to availability, holidays, or unforeseen circumstances. Reasonable notice will be provided where possible.
7. Liability & Risk
Participation in music lessons involves minimal risk. To the extent permitted by law, Musical Minds is not liable for injury, loss, or damage arising from participation, except where liability cannot be excluded under Australian law.
8. Privacy
We respect your privacy and handle personal information in accordance with applicable Australian privacy laws. We use your details to provide services, communicate with you, and manage billing and payments.
9. Changes to These Terms
We may update these Terms from time to time. The most current version will apply from the date it is published.
